These Terms of Service ("Terms") govern your access to and use of the Shorties mobile app and related services

(collectively, the "Service"), including Shorties for iOS, Shorties Mac, and Shorties Desk.

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

1. Agreement and Eligibility

You enter into a binding agreement with Subbie when you use the Service.

You must:

• Be at least 13 years old, or the minimum age of digital consent in your country (whichever is higher)

• Have the legal capacity to enter into these Terms

• Comply with all applicable laws

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to

these Terms.

2. The Service

Shorties provides tools to capture, edit, organize, and export video content, including AI-assisted features such as clip

titling, script generation, voiceover, and audio enhancement. Optional cloud backup via iCloud may be available.

We may add, change, or remove features at any time.

Some features — including voice cloning and other AI tools —

may be offered on a limited, invite-only, or beta basis.

The Service is provided for personal content creation.

It is not a general-purpose hosting platform and is not intended

for illegal, harmful, or infringing use.

3. Your Account

Sign in with Apple is required for certain features, including cloud AI processing.

You are responsible for:

• Maintaining the security of your Apple ID

• All activity that occurs under your account

• Providing accurate information where requested

You may not share, sell, or transfer your account to another person without our permission.

4. Subscriptions and Purchases

Shorties Pro

Shorties offers Shorties Pro, an auto-renewable subscription that unlocks premium features. Plans may include

monthly, quarterly, and annual billing options. Prices vary by region and storefront tier.

Free trials may be offered on eligible plans (for example, a 7-day trial on quarterly or annual subscriptions). If you do

not cancel before the trial ends, your subscription renews automatically at the then-current price.

Billing

All purchases and subscriptions are processed by Apple through the App Store.

We do not collect or store your

payment card information.

• Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period

• Your Apple ID is charged at confirmation of purchase and upon each renewal

• You can manage or cancel subscriptions in Settings → Apple ID → Subscriptions on your device

• Refunds are handled by Apple in accordance with Apple's policies

Apple Media Services Terms

Your use of the App Store version of Shorties is also subject to Apple's Licensed Application End User License

Agreement.

AI Credits

Shorties may offer metered AI credits for certain features on free or promotional tiers. Credit balances, costs per

feature, and availability may change. Consumable credit purchases, if offered, are also processed through Apple.

5. AI Features and Credits

AI-powered features — including script generation, clip analysis, voiceover, audio enhancement, and voice cloning —

are provided as-is.

You understand and agree that:

• AI outputs may be inaccurate, incomplete, or inappropriate

• You are solely responsible for reviewing AI-generated content before publishing or sharing it

• Cloud AI features send data as described in our Privacy Policy

• AI features consume credits or require a Pro subscription, as shown in the app

• We do not guarantee availability, speed, or quality of any AI feature

Voice cloning and other advanced AI tools may be restricted, rate-limited, or withdrawn at any time.

6. Your Content

Ownership

You retain ownership of the videos, audio, images, scripts, and other content you create or import ("Your

Content"), subject to third-party rights in any materials you include.

License to Subbie

To operate the Service, you grant Subbie a limited, non-exclusive, royalty-free license to host, process, transmit, and

display Your Content solely as necessary to provide the Service — for example, to enhance audio through our proxy,

analyze a clip thumbnail for a suggested title, or back up a project to your iCloud account.

This license ends when Your Content is deleted from the Service, except where retention is required by law or our

backup systems.

Your Representations

You represent and warrant that:

• You own or have the necessary rights to Your Content

• Your Content does not violate any law or third-party rights

• You have obtained any required consents from people appearing in or recorded by Your Content

Prohibited Content

You may not use the Service to create, store, or distribute content that:

• Is illegal, fraudulent, or deceptive

• Infringes intellectual property, privacy, or publicity rights

• Is defamatory, harassing, threatening, or hateful

• Depicts non-consensual recording or exploitation of others

• Contains malware or is designed to disrupt the Service

7. Acceptable Use

You agree not to:

• Abuse, overload, or interfere with the Service or its infrastructure

• Scrape, crawl, or systematically extract data from the Service

• Reverse engineer, decompile, or attempt to extract source code from the app or our proxy servers

• Circumvent paywalls, subscription checks, credit meters, or access controls

• Use automated tools to access the Service without our written permission

• Impersonate another person or misrepresent your affiliation

Misappropriation of Shorties Intellectual Property

You may not use the Service — or information obtained through it — to steal, copy, clone, or misappropriate Shorties

intellectual property. This includes, without limitation:

• Copying, cloning, or replicating Shorties's user interface, user flows, visual design, branding, or product concepts

for a competing product

• Reverse engineering, decompiling, or extracting source code, algorithms, or proprietary logic

• Using screenshots, screen recordings, or access to the app to document or reproduce proprietary features for

commercial exploitation

• Creating derivative works based on Shorties without written permission from Subbie8.

Intellectual Property

Shorties — including its name, logos, branding, software, designs, workflows, documentation, and built-in assets — is

owned by Subbie and protected by intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service

for personal content creation.

This license does not permit you to copy, compete with, or build a substitute for

Shorties itself.

All rights not expressly granted are reserved by Subbie.

Third-party names and trademarks (including Apple and App Store) belong to their respective owners.

9. Enforcement, Monitoring, and Account Termination

Monitoring

To protect the Service and our intellectual property, we may use product analytics and security signals — including

screenshot events, screen-recording events, usage patterns, and flagged developer or competitor accounts — as

described in our Privacy Policy.

Our Right to Terminate

If we reasonably believe your account is being used to steal, copy, clone, or misappropriate Shorties intellectual

property, or to violate Sections 6, 7, or 8 of these Terms, we may — without prior notice and at our sole discretion:

• Suspend or terminate your account and access to the Service

• Revoke proxy and cloud AI access tied to your account

• Block your Apple user identifier from future sign-in

• Take any other action we deem necessary to protect our rights, users, or the Service

Where termination is due to a violation of these Terms, we are not obligated to provide a refund for any unused

subscription period. Refund eligibility for App Store purchases remains subject to Apple's policies.

Appeals

If you believe your account was terminated in error, contact hello@subbie.world. We will review your request but are

not obligated to reinstate any account.

Survival

Sections relating to intellectual property, acceptable use, disclaimers, limitation of liability, governing law, and this

enforcement section survive termination.

10. Termination by You

You may stop using the Service at any time. You may delete your account in Settings, which removes local Shorties

data from your device as described in our Privacy Policy.Deleting your account does not automatically cancel an App Store subscription — you must cancel through Apple's

subscription settings.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS,

IMPLIED, OR STATUTORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, SUBBIE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED

WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that

AI outputs will be accurate or suitable for any purpose.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• SUBBIE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE

DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE

• SUBBIE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE

WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SUBBIE THROUGH THE APP STORE IN THE

TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50)

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. In that case, our

liability is limited to the maximum extent permitted by law.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or

intentional misconduct.

13. Indemnification

You agree to indemnify and hold harmless Subbie and its officers, directors, employees, and agents from any claims,

damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your Content

• Your use of the Service

• Your violation of these Terms

• Your violation of any law or third-party rights

14. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.Before filing a formal claim, you agree to contact us at hello@subbie.world and attempt to resolve the dispute

informally.

Any dispute not resolved informally will be brought exclusively in the state or federal courts located in New York,

New York, and you consent to personal jurisdiction in those courts.

15. General

Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and Subbie regarding the Service.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.

Assignment: merger, acquisition, or sale of assets.

You may not assign these Terms without our consent. We may assign these Terms in connection with a

Changes: We may update these Terms from time to time. We will post the updated version at

https://createshorties.com/terms-of-service and update the effective date. Material changes may be communicated through the app

or by email where appropriate. Continued use after changes take effect constitutes acceptance.
